Win a Trolls World Tour Merchandise Pack or Family Movie Pass- Competition Terms and Conditions

  1. The “Win a Trolls World Tour Merchandise Pack or Family Movie Pass” competition (Competition) is conducted by Just Cuts Advertising ABN 18 095 420 223 of First Floor, 4-6 Kingsway Cronulla NSW 2230 (Promoter).
  2. Any information provided about prizes and how to enter the Competition also forms part of these Competition Terms and Conditions (Terms).
  3. By submitting an entry for the Competition (Entry), persons who enter the Competition (Entrants) agree to these Terms.

Eligibility

  1. Entry into the Competition is open to all Australian residents (Australian Entrants) and New Zealand residents (New Zealand Entrants) over the age of eighteen (18) years who comply with the below eligibility requirements. Employees of the Promoter (and members of their immediate family), employees of salons associated with the Promoter (Just Cuts™ Salons) and agencies associated with this Competition (and members of their immediate family) are ineligible to enter.
  2. For the avoidance of doubt “immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  3. To be eligible to participate in the Competition an Entrant must be 18 years of age. Purchases made by a person that is under 18 years of age will entitle their parent or guardian to enter the Competition on their behalf.

Prizes

  1. For Australian Entrants, there is a total of eighty-six (86) individual prizes (Prizes and each the Prize), made up of:
    1. Forty-three (43) Trolls World Tour Merchandise Packs including a tote bag, yo-yo and notepad valued at $40 each; and
    2. Forty-three (43) Trolls World Tour Family Season Movie Pass for two adults and two children valued at $60 each.
  2. For New Zealand Entrants, there is a total of fourteen (14) individual prizes (Prizes and each the Prize), made up of:
    1. Seven (7) Trolls World Tour Merchandise Packs including a tote bag, yo-yo and notepad valued at $40 each; and
    2. Seven (7) Trolls World Tour Family Season Movie Pass for two adults and two children valued at $60 each.
  3. The Prizes will be awarded in the form of:
    1. for the Merchandise Packs, a pack; or
    2. for the Movies Passes, tickets (to be used at the nominated cinemas as per the terms and conditions of the ticket provider),
    one of which (at the sole discretion of the Promoter) will be posted or delivered to the winner’s nominated mailing address by the Promoter within twenty-one (21) days of the relevant draw date.

Entries

  1. Entries to the Competition can only be submitted between 09:00 am 24 February 2020 and 11:59 pm 5 April 2020 (the Promotion Period).
  2. To enter the Competition and be eligible to win the Prizes, Entrants must:
    1. visit the Just Cuts™ Facebook page at https://www.facebook.com/JustCutsSalons/;
    2. find the post pinned to the page with the weekly backstage password;
    3. visit the Trolls World Tour entry page at https://www.justcuts.com.au/;
    4. complete all fields on the entry page, including without limitation their full name, email address, valid mobile phone number, nearest Just Cuts salon and backstage password and then submit the form to go into the draw for the Prize; and
    5. if requested, provide reasonable proof of your identity to claim the Prize.

Terms of Promotion

  1. All Entries must be received by the Promoter within the Promotion Period in the form specified and the Promoter will not accept any liability for Entries which are rejected because they are late, lost, incomplete, incorrect or otherwise not able to be received or processed. As this promotion is a game of chance, and subject otherwise to these Terms, skill plays no part in determining the winner and each valid Entry will not be individually judged. The winning Entrants are those persons whose Entry is drawn in accordance with the process set out below.
  2. Entrants must enter the Competition in their own name. Multiple entries are strictly prohibited and each Entrant may only enter the Competition once. Further entries by the Entrant will be deemed invalid.
  3. Entrants are responsible for any and all expenses incurred when entering and accessing the Competition and/or claiming the Prize, unless otherwise stated.

Records

  1. The total value of the prize pool for Australian Entrants is $4,300.
  2. The total value of the prize pool for New Zealand Entrants is $700
  3. All Entries become the property of the Promoter. Entrants acknowledge that their Entry and all material included in the Entry will be the property of the Promoter. The Entrant grants the Promoter a world-wide, royalty free, exclusive, assignable licence to use the material that it provides as an Entrant to the Competition. The licence under this clause will survive the expiry of the Promotion Period.
  4. The records of Entries by Entrants are final and conclusive as at the time of submission. Incomplete, invalid, indecipherable Entries and those that do not meet the eligibility requirements will be deemed invalid.
  5. The Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant and the validity of the Entry if there is a dispute.
  6. The Promoter reserves the right in its sole discretion to disqualify any Entry if the Promoter has any reason to believe that the Entrant has breached these Terms or engaged in any unlawful or other improper misconduct relating to the Competition.

Draw

  1. The electronic draw of the Prizes will take place at Green Eagle Distribution & Fulfilment, Unit 5, 9 Fitzpatrick Street Revesby NSW 2212. The winners will be drawn on the first Monday after the commencement of the Promotion Period, and each Monday thereafter until all the Prizes have been allocated to winners (each a Draw Date). On each Draw Date, [14] winners will be drawn from the Australian Entrants, and [2] winners will be drawn from the New Zealand Entrants. Except for the final Draw Date where [16] winners will be drawn from the Australian Entrants, and [4] winners will be drawn from the New Zealand Entrants.
  2. The Promoter will award one Prize to each winner. The choice of Prize (i.e. a Merchandise Pack or a Movie Pass) shall be at the sole discretion of the Promoter.
  3. The Promoter will notify the winners by the email address or mobile phone number that they used to submit the Entry that they have won a Prize and will announce winners on the Promoter’s website at https://www.justcuts.com.au, on the following business day after the relevant draw date.
  4. If a Prize is not accepted or claimed by a winner within 3 calendar months, the draw will take place at the same time and place as the original draw, 3 calendar months from the original draw date and subject to any directions from a regulatory authority. The new winner will be notified in accordance with clause 24.
  5. The Promoter reserves the right to select a different Entrant to receive the Prize, subject to clause 24 and any directions from a regulatory authority.
  6. The Promoter’s decision is final in relation to the Prizes, and no correspondence will be entered into, including in the event of a dispute.

General

  1. By submitting an Entry to the Competition, Entrants are sending their personal information to the Promoter. All information collected will be treated in accordance with our Privacy Policy available at https://www.justcuts.com.au/privacy. Entries are not confidential.
  2. Entrants agrees to the use of their first name, last name, photograph, social media handle and suburb/nearest Just Cuts™ Salon location for publicity and Competition purposes and promoting any products manufactured, distributed and/or supplied by the Promoter. The Entrant will not receive any compensation or remuneration for the use of this information or the publicity derived from it.
  3. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct or indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third-party interference;
    3. any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any variation in prize value to that stated in these Terms;
    5. any tax liability incurred by an Entrant or winner; or
    6. use of a Prize.
  4. Prizes cannot be exchanged or transferred by the winner. If any Prize is unavailable for whatever reason, the Promoter reserves the right to substitute the Prizes in accordance with Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), subject to written directions of the relevant regulatory authority. The Prize must be taken as offered and cannot be varied by the winner. The Promoter retains the right to substitute the Prizes with prizes of equal or greater value or a portion of the Prizes with a portion of equal or greater value.
  5. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter or a force majeure event, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
    1. to disqualify any Entrant; or
    2. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
  6. The Promoter will give public notice of such an event and that the promotion has been modified, suspended, terminated or cancelled (as appropriate).
  7. For the avoidance of doubt a ‘force majeure event’ includes, but is not limited to, an act of god, fire, explosion, vandalism, storm or other similar occurrence, orders or acts or military or civil authority, or by national emergencies, insurrections, riots, or wars, strikes, lockouts and work stoppages, terrorism, infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion.
  8. These Terms are governed by the laws of Australia and the state of New South Wales. Entrants submit to the exclusive jurisdiction of the courts operating in Australia and the state of New South Wales.
  9. These Terms may be amended or replaced from time to time if required by any regulatory authority.
  10. References to time/s and deadline/s in these Terms refer to Australian Eastern Daylight Savings Time during summer in Australia and Australian Eastern Standard Time during winter in Australia.
  11. References to business day means a day which is not a Saturday, Sunday or a bank or public holiday in the state of New South Wales.
  12. References to dollars or $ is a reference to Australian dollars.
