1. The “Ride Back to School in Style at Just Cuts”- competition (Competition) is conducted by Just Cuts Advertising Pty Limited ABN 18 095 420 223  (Promoter).
2. Any information provided about prizes and how to enter the Competition also forms part of these Competition Terms and Conditions (Terms).
3. By submitting an entry for the Competition (Entry), persons who enter the Competition (Entrants) agree to these Terms.

Eligibility

4. Entry into the Competition is open to all Australian and New Zealand residents over the age of eighteen (18) years. Employees of the Promoter (and members of their immediate family), employees of salons associated with the Promoter (Just Cuts™ Salons) and agencies associated with this Competition (and members of their immediate family) are not eligible to enter, with the exception of the Major Stylist Prize. This exemption does not apply with respect to the Major Stylist Prize, as described below.
5. For the avoidance of doubt “immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
6. To be eligible to participate in the Competition an Entrant must be 18 years of age. Purchases made by a person that is under 18 years of age will entitle their parent or guardian to enter the Competition on their behalf.

Prizes

7. There are a total six (6) individual prizes (Prizes and each the Prize), and six Stylist Prizes made up of:
   1. six (6) Fatboy Harlem eBike’s (Major Customer Prizes), with one eBike to be distributed as follows and otherwise consistent with these Terms:
      1. 1x New Zealand
      2. 2x NSW/ACT
      3. 1x QLD
      4. 1x WA/SA/NT
      5. 1x VIC/TAS; and
   2. six (6) $1,000 Cash Prizes (Major Stylist Prizes).
8. The Major Customer Prizes will be distributed to the Just Cuts™ Salon at which the relevant Style Cuts™ was purchased by the winner/s, who hereby agree to collect the eBike at their sole cost from that location.

How to Enter

9. Entries to the Competition can only be submitted between 09:00 am on 6 January 2025 and 11:59 pm on 9 February 2025 (the Promotion Period).
10. To enter the Competition and be eligible to win the Prizes (subject to clause 11), Entrants must:
    1. visit any Participating Just Cuts™ Salon and purchase a Style Cuts™ cut
    2. agree to enter the Competition upon being asked by the Just Cuts™ Stylist
    3. if the Entrant is in a Participating Just Cuts™ Salon, provide the Just Cuts™ Stylist with both their email address (in addition to the Entrant’s name and valid mobile phone number which is usually provided to the Promoter before the Style Cuts™), at the point of purchase; and
    4. The Entrant will be emailed a receipt by the Just Cuts™ Stylist which will contain the words “Good Luck, you are in the draw to win 1 of 6 ebikes. For full terms and conditions visit justcuts.com” (Receipt). The provision of the receipt confirms the Entrants entry into the Competition (the Entry).
    5. The Entrant must retain the Receipt for the duration of the Promotion Period and if requested, provide the Receipt and/or reasonable proof of identity to claim a Prize.
11. Just Cuts™ Stylists will be automatically entered into the draw to win the Major Stylist Prizes during the Promotion Period if their name is listed on an Entry. The Stylist that provided each winner with the relevant Style Cut™ shall be entitled to a Major Stylist Prize
12. Entrants who use the digital Check-In solutions available either at the Just Cuts™ App (available via Google Play or Apple Store) or if they check in on the Self Check-In Kiosk in a Salon (Digital Check-In), will be eligible for triple entry, such that the relevant Entry shall be submitted three times and, accordingly, they shall have triple the chance of winning as an Entrant who does not use the Digital Check-In solutions (Triple Entry). Triple Entry in accordance with this clause is not available to Just Cuts™ Stylists.

Term of Promotion

13. All Entries must be received by the Promoter within the Promotion Period in the form specified and the Promoter will not accept any liability for Entries which are rejected because they are late, lost, incomplete, incorrect or otherwise not able to be received or processed. As this promotion is a game of chance, and subject otherwise to these Terms, skill plays no part in determining the winner and each valid Entry will not be individually judged. The winning Entrants are those persons whose Entry is drawn by a random computer-generated selection on a draw date per clause 24 or clause 26, as applicable.
14. More than one (1) Entry per person, will be accepted if a person complies with these Terms. One (1) transaction Receipt is required for one (1) Entry. For the avoidance of doubt, each service purchased on the same transaction will not each constitute an Entry.
15. Entrants are responsible for any and all expenses incurred when entering and accessing the Competition and/or claiming the Prize, unless otherwise stated.

Records

16. The total value of the prize pool is $29,940. The Major Customer Prizes are valued up to $23,940 collectively (each Major Customer Prize is worth $3,990) and the Major Stylist Prizes are collectively valued up to $6,000 (6 x $1,000 cash).
17. All Entries become the property of the Promoter. Entrants acknowledge that their Entry and all material included in the Entry will be the property of the Promoter. The Entrant grants the Promoter a world-wide, royalty free, exclusive, assignable licence to use the material that it provides as an Entrant to the Competition. The licence under this clause will survive the expiry of the Promotion Period.
18. The records of Entries by Entrants are final and conclusive as at the time of receipt by the relevant Participating Just Cuts™ Salon. Incomplete, invalid, indecipherable Entries and those that do not meet the eligibility requirements will be deemed invalid.
19. The Promoter reserves the right, at any time and in its sole discretion, to verify the validity of an Entry and Entrants (including Entrant’s identity) and to disqualify any Entrant if their Entry or identity cannot be verified. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
20. The Promoter reserves the right in its sole discretion to disqualify any Entry if the Promoter has any reason to believe that the Entrant has breached these Terms or engaged in any unlawful or other improper misconduct relating to the Competition.

23. A record of all Entrants will be collated from an online system and at the end of each business day, a valid entry list (Entry List) will be generated.

Draw

24. The electronic draw of the Major Customer Prizes will take place at Green Eagle Distribution & Fulfilment, Unit 5, 9 Fitzpatrick Street, Revesby, New South Wales 2212, Australia. The winner will be drawn at 12:00 pm on 10 February 2025, with the draw to occur ‘live’ and be promoted online at the Promoter’s website at www.justcuts.com and/ or any associated social media accounts, as nominated by the Promoter.
25. Entrants expressly agree that their name and state may be published by Just Cuts™ as part of the ‘live draw’ if they are a winner.

25. The Promoter will notify the winners by the email address or mobile phone number that they used to submit the Entry that they have won a Prize and will announce winners on the Promoter’s website at www.justcuts.com, on the following business day of the draw dates set out in clause 24.
26. To claim a Prize, a winner must collect the eBike from the relevant Just Cuts™ Salon from which the entry was placed, and hereby expressly agrees to be photographed and/ or filmed during such collection, which photographs and/ or footage:
    1. will be the property of the Promoter; and
    2. may be used by the Promoter for promotional purposes at their sole discretion.

26. The Prize must be taken as offered and cannot be varied. No prize is transferable or exchangeable, nor can it be redeemed for cash (unless otherwise indicated). In the event for any reason a winner does not take an element of any Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the winner and cash will not be supplied for that element of the Prize.
27. The Promoter accepts no responsibility for any variation in Prize value. Where a Prize (or part thereof) is unavailable for any reason, the Promoter may substitute for that Prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant authorities in the Eligible States and Territories.
28. The Promoter is not responsible for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
29. If a Prize is not accepted or claimed by a winner within 3 calendar months, the draw will take place at the same time and place as the original draw, 3 calendar months from the original draw date (in accordance with clause 24) and subject to any directions from a regulatory authority. The new winner will be notified in accordance with clause 25. For the avoidance of doubt, if the Major Customer Prize or any of them is not accepted or claimed by a winner within 3 calendar months, the draw will take place on 10 May 2025 (or, if not a business day, the next business day) at the same time and place as the original draw.
30. The Major Stylist Prizes will be transferred electronically to the bank account nominated by the Stylist. Just Cuts Stylists agree and acknowledge that they must have a valid Australian Bank Account to be eligible to win the Major Stylist Prizes.
31. The Promoter’s decision is final in relation to the Prizes, and the Promoter is not obliged to enter into any correspondence, including in the event of a dispute.

Collection of Information and Promotion

32. The Promoter collects personal information in order to conduct the Competition and for other purposes as set out in the entry form or page for the Competition and may, for this purpose, collect, use and disclose such information to third parties, including but not limited to the Promoter’s agents, contractors, service providers and Prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information and by submitting an Entry to the Competition, Entrants are sending their personal information to the Promoter. Entrants should direct any request to opt out, access, update or correct their information to the Promoter. All information collected will be treated in accordance with our Privacy Policy available at www.justcuts.com.au/privacy. Entries are not confidential.
33. Entrants agree to provide their first name, last name, photograph, social media handle and suburb/Participating Just Cuts™ Salon location and Just Cuts™ Stylist name to the Promoter, for publicity and Competition purposes and promoting any products manufactured, distributed and/or supplied by the Promoter. The Entrant will not receive any compensation or remuneration for the use of this information or the publicity derived from it.
34. Entrants must, at the Promoter’s request, participate in all promotional and publicity activity in connection with this Promotion or the winning of any Prize, free of charge, and sign any additional documents reasonably required by the Promoter to give effect to this condition
35. An entrant consents to the Promoter, its promotional partners, prize suppliers and its related bodies corporate using the entrant’s name, likeness, entry, image and/or voice in any media for an unlimited period of time without further notification, remuneration or compensation for any purpose in connection with the Promotion.

Liability

36. The Promoter, its promotional partners, prize supplier and their related bodies corporate will not be liable for any direct or indirect loss (including, without limitation, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
37. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of Prizes.
38. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
39. The Promoter makes no representations as to the nature of the Prize(s), including that it is fit for any specific purpose. All liability associated with or arising from the Prize(s) shall vest with the manufacturer. The Entrant expressly agrees that the Promoter is not a manufacturer or distributor of the Prize(s).
40. The Promoter has no control over communications networks or services, third party online or technical partners, Smart Speaker Platform availability, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
41. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth).

General

42. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter or a force majeure event, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
    1. to disqualify any Entrant; or
    2. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
43. The Promoter will give public notice of such force majeure event and that the promotion has been modified, suspended, terminated or cancelled (as appropriate).
44. For the avoidance of doubt a ‘force majeure event’ includes, but is not limited to, an act of god, fire, explosion, vandalism, storm or other similar occurrence, orders or acts or military or civil authority, or by national emergencies, insurrections, riots, or wars, strikes, lockouts and work stoppages, any widespread illness, epidemic or pandemic (including COVID-19 and any variation or mutation of the disease), terrorism, infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion
45. These Terms are governed by the laws of Australia and the state of New South Wales. Entrants submit to the exclusive jurisdiction of the courts operating in Australia and the state of New South Wales.
46. These Terms may be amended or replaced from time to time if required by any regulatory authority.
47. References to time/s and deadline/s in these Terms refer to Australian Eastern Daylight Savings Time during summer in Australia and Australian Eastern Standard Time during winter in Australia.
48. References to business day means a day which is not a Saturday, Sunday or a bank or public holiday in the state of New South Wales.
49. Prize values are based on recommended retail prices and are correct at the date of publication of these promotion terms and conditions (inclusive of GST). The Promoter accepts no responsibility for any change in Prize value between now and the ultimate date individual Prizes are taken.
50. References to dollars or $ is a reference to Australian dollars.
